WHO CAN ENTER

The Prosper Insights "Stein Mart Gift Card Giveaway" Sweepstakes (the "Sweepstakes") is open to U.S. residents, 14 years of age and older. The Sweepstakes is void where prohibited. Prosper Insights is a trademark of Prosper Business Development (“Prosper”). Prosper and any of Prosper’s affiliated entities authorized to use the Prosper Insights trademark are collectively referred to herein as “Prosper Insights”. Employees or agents of Prosper Insights, Stein Mart or any of their affiliate organizations, including without limitation, advertising and promotional agencies, including any such employees’ or agents’ immediate family members or household members, are not eligible to enter.

HOW TO ENTER

Any qualified person can enter the Sweepstakes by becoming a qualified entrant in the Prosper Insights ("Prosper Insights") Stein Mart Customer Advisory Board Survey conducted between July 1, 2013 and September 30, 2013. All qualified entries will be treated equally. All information provided to Prosper Insights in connection with this Sweepstakes shall be treated by Prosper Insights in accordance with the Prosper Insights privacy policy located at www.Prosper Insights.info/privacy-stein.htm, and shall be the sole and exclusive property of Prosper Insights and Stein Mart.

ENTRY LIMIT

All Entrants must provide accurate e-mail address or other valid contact information to be eligible to win the Sweepstakes. By entering the Sweepstakes all Entrants acknowledge compliance with these Official Rules and Regulations, as posted, and all eligibility requirements. Neither Prosper Insights nor any of its affiliates are responsible for inaccurate, incomplete, or incorrect entry of information. This includes, but is not limited to, human error, lost data transmission or any other technical errors including line failures of any telephone, computer or networking equipment or any software. Any entries found to be tampered with or altered in any way will be void. Prosper Insights has the right to cancel and re-schedule the Sweepstakes at any time if the technical transmissions become corrupted or interrupted.

PRIZES

The prizes for the Sweepstakes are as follows: One (1) $250.00 Stein Mart Gift Card; Ten (10) $25.00 Stein Mart Gift Cards. The odds of winning depend upon the number of eligible entries for the Sweepstakes received. The Winner is solely responsible for all federal, state and/or local taxes related to the prize he/she has won. The Winner's right to his/her prize is nontransferable and nonsalable.

SELECTION OF WINNERS

Sweepstakes entries will be accepted from July 1, 2013 through September 30, 2013. Eleven (11) Sweepstakes Prize Winners will be chosen by a random drawing from all eligible entries before October 31, 2013. Each Winner will be randomly awarded one (1) of the prizes listed above. The Winners will be notified via the e-mail address provided by the Entrants as contact information and will have 30 days from the date he/she is notified to redeem the prize. Failure to respond within 30 days of notification will result in the disqualification of the Winner.

GENERAL

By participating in the Sweepstakes, each Entrant agrees to release and hold Prosper Insights, Stein Mart and their employees, officers, directors, shareholders, agents and representatives harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation, or invasion of privacy. The Winner agrees, as a precondition for the receipt of any prize, to execute all releases and other documentation reasonably requested by Prosper Insights.

Each Winner may be required to sign and return a release of liability, declaration of eligibility, and, where lawful, a publicity consent agreement, all within 10 days of acknowledged notification. If any Winner is under the age of 18, Prosper Insights will require the signature of a parent or legal guardian. By accepting the prize, the Winner agrees to the use of his/her name, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law or by the Prosper Insights privacy policy. If the selected Winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, the prize may be forfeited. In the event of a dispute regarding the identity of the individual that submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account or telephone number if no e-mail account is provided.

If, for any reason, the Sweepstakes is not capable of running as planned, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Prosper Insights which corrupt the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Prosper Insights reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes.

This Sweepstakes, and all promotions relating thereto, are subject to all federal, state, and local laws and regulations. This Sweepstakes, and any promotions relating thereto, including the interpretation of these Official Rules and Regulations, are governed by the laws of the State of Ohio, and, by entering the Sweepstakes, each Entrant submits to the personal jurisdiction of the State of Ohio.
